just to point out that none of it would apply
as Wupload is not a legally registered
company in the UK and it has no status in UK.

Either way anyone can sue anyone for
anything but it does not mean they will win.

I don't see why I should. And how do you know they aren't registered in the UK? Their sister site (FileSonic) pays its affiliates via a company in the UK so there is the possibility WUpload also has a presence there.

And I would also like you to read my post more clearly next time. You will notice I said other countries have similar laws. Very similar in fact and in some cases harsher than their counterparts in the UK. So yes they can sue you and I hate to say it, but they will also likely win as well. If you don't mind being sued personally then good for you, but I'm guessing that means you don't like money then?

the domain name is not even unquie. there are a lot of site with .com and .co someone else
has it.this is crazy. is like me putting googleforum.com

You're wasting your time here trying to argue with idiots who think they're certified/qualified lawyers and know the law in and out. IMO you should just let them do what they want to; they'll know how real world works when shit comes down on them. ;)

I gave you two possible causes of action under UK law earlier. One of them was the tort of passing-off. A quick google would have turned up this link http://en.wikipedia.org/wiki/Passing_off.

One recent case involved the UK mobile phone retailer 'Phones 4 U.' The defendant had registered the domain name phone4u.co.uk and people were mislead into believing that it was in fact the actual company's website. As a result they sued the registrant and won. I believe they were also able to take control of the domain name.

This may be a British case, but like I said earlier, there are similar laws in most other countries.

Well i would give this a big -10/10 myself. Trying to move in on someone elses success is lame if you ask me,using their name for benifit of seo is one thing,but using thier brand from their logo,and even their tagline,now that could be construed as copyright infringment (if indeed they have a copyright or anything). And even if they dont its just lame,why cant people here come up with their own original ideas instead of riding teh coat tail of someone else?
