Here we go again ... Of course It's illegal to operate a Website (blog,forum) with copyrighted informations on it. It's illegal everywhere.
There is a difference of course if you're asking your members to buy FTP access on some server on which you have uploaded movies,games, tv series, etc. That's bigger crime than providing the links from some site (RapidShare,MegaUpload,etc.) , because you're actually profiting directly from the copyrighted movies,music,tv series, etc.

If you haven't noticed. Warez-BB is:
- Family community
- There is no porn
- Only normal ads are being shown, no porn, or malicious ads.
- Owner is cooperating with all copyright organizations.
- Nothing can be seen when you're not registered.
- They're not encouraging their members to upload anything.
- They're pretty much the old school.
So who would be against Warez-BB Owner, and why? I know, I would have nothing against such person.

I know you're not against him, I was giving you example who could be against him? Even cops are using Warez-BB.
Sure, you can own a warez forum anywhere in the world, especially if you're smart enough not to have those "Earn Money now", "FileSonic pays you", "FileServe", bla bla. You know what I mean, those stupid ads. You don't need "offshore" host for a forum, but if you're that paranoid, you can always buy a VPS in Ukraine, Bosnia, Russia, etc. But I suggest you to cooperate, and if you do. You'd be perfectly fine anywhere, even though some problems may occur if your forum grows fast. And if it becomes a hangout for greedy wannabe uploaders.
But it would be better not to start another warez forum, it's well known that warez became source of the money for lots of people. It's good to share with friends, but it's not good to share with everyone. Give me one good reason why should everyone have Otep's discography? If everyone had access to download it. She would earn NOTHING from her album(s). Because it's pirated all over the world.
If you want to start a site, start a private torrent tracker for YOU, and YOUR friends. Never aim high, such as: "I want to start a worldwide warez forum". You'd be no one compared to them. And frankly, If you were a film director/writer, you wouldn't like that your film one day after its released on a private torrent tracker gets leaked by some 14yo kiddo via RDP on all warez forums, and not because he liked it. It's just because it will generate the points.

If you start receiving donations or selling a VIP membership then it's very illegal and you will be shutdown and maybe even sent to jail if your site gets big.
Just look at warez-bb, they don't have a VIP or donator status anymore. You have to work to earn the status, you can't give them money anymore.
US hosts are more likely to take off your illegal content then european/asian hosts, that's why we host offshore. But it's still illegal.
And if you put your name out there and make it easy to find then you're just setting yourself up.

Jason, honestly I do respect you and your views but let me ask you a question, why are you pessimistic?
It's true that warez became saturated lately, however you still have the chance to get in a challenge with your competitors! What is the difference between you and other webmasters who own successful sites?
someone reads more and try to improve his site, another one just submit to katz and other ddls.
It's just about 'knowledge' IMO.

Agreed, with the rest of your post as well.
In 2 years from now everything will be completely changed again. Small sites grown big, sites that are big now, will be mostly dead (taken down or whatever)

I'm not pessimistic, you're missing the point. It's not about who will have more unique visits and pageviews. It's about something else, people here totally lost the true warez spirit. When you create a forum (community) you don't create it for money, or profit (even though everyone likes money). You create it to show others that you're capable, or to have a hangout for your friends, some communities are born after some community dies. But today, all forums are born with just one cause, to compete with the Gods.
To have a successful forum you can't just leech downloads from other sites, you can't expect someone will come on your forum when it's full of ads and it started few months ago (this is just an example, I'm not aiming at your site) . There is something more in it. If you need money, you either work for it or you steal it. Money in warez comes after few years. Another funny thing I've seen is selling those text links on forums uglier than Celine Dion, and they think they will get them some visits. Even though It's just a trick from the experienced "Webmasters" to earn more money.
This whole "is warez ok" and "warez isn't for profiting" is being discussed almost every day...
Okay I am from the USA and my site is in the USA. There are several others that I know that are on the same host, we all started about the same time.
We are all considered "Old School " sites but are happy with our host and and accomplishments. It is all in what you want from a forum, I guess.

The problem with hosting on shore is that it's very, very simple to get your information (such as PP or CC) subpoena'd.
Something that really baffles me is how naive people are. Has no one been reading recent file sharing related lawsuits? Hosting in the USA basically gives them a pretty strong jurisdiction over you.

Just to update this whole topic.
They took down a lot more streaming sites today. Torrent freak did a follow up article here http://torrentfreak.com/u-s-seizes-sports-streaming-sites-in-super-bowl-crackdown-110202/
They are all sports streaming sites and it seams pretty obvious it's because of the Super Bowl this weekend.
As far as the copyright goes. It's all getting a bit weird. Their are only a few countries you can host in and the number of domains you can use is getting smaller too. .com, .net, .org .ws, .co.uk .us, and loads more seam to be avoidable if you have a big site and the list keeps growing.
Maybe more large sites should take the same precaution of demonoid.com and redirect before they lose the domain completely or at least have a backup plan.
