I do not have a copy of the ToS but I would think the claim or accept no responsibility for the file, so you own the file if that is the case.

However when they state they reserve the right to deny access to or delete without notice they remove any liability of potential loss of data.

They cover their ass, not yours!

They should pursue this coz a lot are using Megaupload for personal storage only & not for sharing.
