Are movie samples illegal?

Hello,

As topic reads are a short movie sample from a movie illegal to host? My site fileporn.biz uses another hoster (justuseme) to upload samples of my xxx uploads so that users can stream which i think is a nice feature.

But i have been thinking about hosting them myself to make the experiance even cleaner and keep the users on my site instead of having to go to justuseme to watch the sample.

But a question i have is if it would be illegal to host these samples on my own or is it okay to just host a short sample (couple of mins) of a full movie? My guess is that it is illegal but i am not sure.

But if you take lets say a movie, rar it up etc one of these rar files wouldnt make the file illegal? So really cant see why a 1 min sample of a 120min long movie should be illegal but i guess it still is because some retard law. :P

Well i probably need to get a new server just for the video hosting so not hosting it directly on the same site as lets say fileporn.biz etc. But one thing would maybe be to remove the sample if someone contacts me and make a new one and upload again and wait for a new complaint. :P

Hmm, no, but with the 1 rar file you can't view the illegal material. With the 1 minute sample, you do.

It's like.. is stealing a lollypop illegal.. no.. only a full bag of groceries is :)
Stealing the lollypop alone is just as bad, even if it's only a fraction of what you else would've stolen
 
I'm not a lawyer so don't take my word for it. But I believe it is legal as long as the samples are not longer than 30 seconds. It's legal to have a music snippet, publish quotes from a book or other copyrighted text, show game footage in a review, etc. So I would guess it's legal.
 
Yeah @ Hyperz it did, which is indeed completely different.

However, samples get deleted from rapidshare and stuff as well, so I can only assume they are copyrighted. I mean, it's a snippet, but still as snippet of the copyrighted stuff, therefor, it's still copyrighted.
 
Of course samples are copyrighted. The question is if it is legal to host samples. I still think it is as long as certain conditions are met (such as length of the sample and the time at which the sample gets published). In the US it might be a different story though because the government and laws are highly influenced by the copyright mafia.

Anything copyrighted is NOT safe to host :p.
Copyrighted=copyrighted... simple as that, so not safe for hosting.
(these are my thoughts by the way, I'm not 100% sure on this either as I'm also not a lawyer :()

That's not true though. For example open source software is copyrighted too. In fact almost everything has copyright attached to it. Copyright says more about who is the author and owns the work or the legal side of distributing or reproducing it. A sample is a sample of that work and not the full copyrighted work/product. If you don't use a sample for financial gains there shouldn't be much of a problem.

Bull shit...u can unrar a part of any rar file and view it :)
 
My guess is it would be.

If the company only released a trailer for free the rest is illegal. A sample is legal if its the same parts as the trailer im guessing as thats the only part they want you to see.
